These Terms of Service apply to all services provided by Busy Little Truck unless otherwise agreed in writing.

1. Acceptance of Work

• By accepting an estimate, quotation or price, confirming a booking, or instructing Busy Little Truck to proceed with the work, you agree to these Terms of Service.

• Estimates and quotations are valid for 14 days unless otherwise stated.

2. Pricing

• Unless otherwise stated, all prices provided by Busy Little Truck are exclusive of GST.

• Unless specifically stated as a fixed quote, all prices provided by Busy Little Truck are estimates. Estimates reflect the nature of our work, where the full scope of the job cannot always be determined until work begins.

• The final price may vary depending on factors including, but not limited to:

  • The scope of work required

  • The time required to complete the work

  • Access to the site

  • The volume, weight or type of waste (where applicable)

  • Disposal, recycling or tipping costs (where applicable)

  • Materials, consumables or equipment hire required

  • Additional work requested by the client

  • Unexpected site conditions or circumstances identified during the job

• Where reasonably practicable, Busy Little Truck will discuss any significant variation in the estimated cost with the client before proceeding.

3. Additional Items

• Busy Little Truck will complete the work as agreed with the client.

• If additional items or tasks are requested once work has begun, these may result in additional labour time and disposal costs.

• Where possible, Busy Little Truck will confirm any additional costs with the client before proceeding.

4. Mileage

• Travel within 20km one way from Busy Little Truck’s base in Mount Maunganui is included in the estimate.

• Travel beyond this distance will be charged at $1.00 per kilometre.

• Mileage charges will be added to the final invoice where applicable.

5. Materials, Disposal & Additional Costs

• Disposal fees, recycling fees, green waste charges, materials, equipment hire, and any other third-party costs are additional unless specifically included in the estimate.

• Where reasonably practicable, Busy Little Truck will provide an estimate of these costs before commencing work. Actual costs may vary and will be charged at cost, plus a reasonable margin where applicable to cover sourcing, handling, transport and administration.

• Where waste removal forms part of the work, Busy Little Truck will recycle or donate suitable items wherever reasonably practicable before disposing of the remaining waste at an appropriate facility.

6. Payment Terms

• Unless otherwise agreed in writing, Busy Little Truck will issue an invoice on completion of the work, and payment is due by the due date stated on the invoice.

• Where Busy Little Truck has entered into a separate written agreement with an agency, contractor, commercial client, or other organisation, the payment terms contained in that agreement will apply instead of these Terms of Service.

• Busy Little Truck reserves the right to require a deposit before commencing work, particularly for larger or higher-value jobs.

• If payment is not received by the due date, interest may be charged on overdue balances at a rate of 2% per month.

7. Overdue Accounts

If an invoice remains unpaid after the due date, Busy Little Truck reserves the right to:

• Suspend or decline to carry out further work until all outstanding amounts have been paid in full.

• Refer the outstanding account to a debt collection agency or take legal action to recover the amount owing.

• Recover from the client all reasonable costs incurred in recovering the outstanding amount, including administration costs, debt collection agency fees, legal costs, court costs, and any other costs recoverable by law.

8. Safety & Hazardous Materials

Busy Little Truck does not handle hazardous materials, including but not limited to:

• Asbestos

• Chemicals

• Biohazards

• Medical waste

If hazardous materials are discovered during the job, Busy Little Truck may stop work immediately until safe removal can be arranged. Any resulting delays or additional costs will be discussed with the client before work recommences, where reasonably practicable.

9. Property Conditions and Access

• The client must ensure Busy Little Truck has safe and reasonable access to the property and work area at the scheduled time.

• Clients must advise Busy Little Truck of any known hazards or conditions that may affect the work, including underground services, irrigation systems, concealed pipes or cables, septic systems, fragile surfaces, restricted access, or any other relevant site conditions.

• Busy Little Truck will take reasonable care when carrying out the work but cannot be held responsible for damage resulting from hidden, unknown or undisclosed site conditions that could not reasonably have been identified before work commenced.

10. Damage and Liability

Busy Little Truck will carry out all work with reasonable care and skill using appropriate equipment and methods. Busy Little Truck is not responsible for:

• Pre-existing damage or defects.

• Hidden structural issues.

• Damage resulting from unknown or undisclosed site conditions, including buried objects, underground services, irrigation systems, brittle materials, unstable structures, deteriorated surfaces, or other conditions that were not reasonably identifiable before work commenced.

• Damage that is an unavoidable consequence of carrying out the agreed work, provided Busy Little Truck has exercised reasonable care and skill.

Any concerns regarding the completed work must be raised within 48 hours of completion to allow Busy Little Truck the opportunity to investigate and, where appropriate, remedy the issue.

11. Existing Structures & Repairs

• Property maintenance, gardening, demolition and removal work may expose pre-existing damage, deterioration, decay, corrosion, rot, pest damage, or other defects that were not visible before work commenced.

• Busy Little Truck is not responsible for repairing or replacing pre-existing defects unless this forms part of the agreed scope of work.

• Where unexpected issues are identified during the course of the work, Busy Little Truck will, where reasonably practicable, discuss the available options and any additional costs with the client before proceeding.

12. Insurance

Busy Little Truck holds public liability insurance. While all reasonable care is taken when carrying out work, clients acknowledge that property maintenance and waste removal work can involve inherent risks, particularly where conditions or structures are unknown prior to work commencing.

13. Weather Delays and Cancellations

• Outdoor work may be rescheduled due to weather conditions for safety or quality reasons.

• Busy Little Truck will communicate any necessary changes as soon as possible.

• Please provide at least 24 hours notice if cancelling or rescheduling a job.

• If a job is cancelled where a deposit has been paid, Busy Little Truck reserves the right to retain the deposit to cover time, scheduling and administrative costs.

• Busy Little Truck will not be liable for delays caused by adverse weather or other circumstances outside its reasonable control.

14. Photographs

Busy Little Truck may take before and after photos of completed work for internal records or marketing purposes. No identifying personal information will be shared without permission. Busy Little Truck retains ownership of all photographs taken during the course of the work. If you would rather we don't take any photos of your job, please contact us in writing.

15. Consumer Guarantees Act

• Where the client is acquiring services for personal, domestic or household use, nothing in these Terms of Service limits or excludes any rights available under the Consumer Guarantees Act 1993.

• Where the client acquires services for business purposes, the parties agree that, to the extent permitted by law, the Consumer Guarantees Act 1993 shall not apply.

16. Privacy

Busy Little Truck will only collect and use personal information for the purpose of providing our services, communicating with clients, issuing invoices, recovering outstanding amounts where necessary, and complying with legal obligations. We will not share personal information except where required to provide our services or as required by law.

17. Governing Law

These Terms of Service are governed by the laws of New Zealand and any disputes shall be subject to the non-exclusive jurisdiction of the New Zealand courts.
